Hiring a private caregiver without a home care agency being involved, you would need to interview and hire that person you would want in your home caring for your loved one. With this choice, you become the employer.

Questions to ask Yourself Before Hiring Private Caregivers?

  • Who will provide care if the private caregiver you hired is sick or can’t be there for their shift?
  • If you have a “live-in” caregiver, what happens when you want to fire them, do you have to go through the eviction process as well?
  • Who will you hire to do background checks, drug testing, reference and skills evaluations or monitor the care you are receiving?
  • Are you sure you want to handle all the tax paperwork required of employers to avoid penalties?
  • Do you have proper insurance to cover falls, liability, theft, etc?

If you employ a private caregiver in your home, the IRS and state taxing authorities classify you as a household employer. If you pay over the wage limit of approximately $1700 in a year to any one private caregiver, you must report these wages, along with file tax forms and payroll taxes. In most cases people make the choice to not fulfill their obligations as an employer and decide to pay their private caregivers “under the table”. Payment of wages by check, cash or other compensation, with the intention of avoiding payroll taxes is illegal. This is also tax fraud and could result in charges of tax evasion or perjury
